These Terms and Conditions and Chewy, Inc.'s ("Chewy") Terms of Use found here govern your conduct associated with the Customer Review and Q&A service offered by Chewy.
You agree to not submit the following type of content or any content that violates the guidelines below and Chewy reserves the right not to post your review, question or response if it contains any of the following types of content or otherwise violates these guidelines:
- Generally inappropriate comments, photos, videos or music including without limitation those that are obscene, threatening, defamatory, libelous, discriminatory, harassing, or anything else that is not suitable for a public forum. Content that appears to solicit or provide medical advice.
- Advertisements, "spam" content, or references to other products, offers, or websites.
- Email addresses, URLs, phone numbers, social security numbers, bank account numbers, credit card numbers, physical addresses or other forms of contact or personally identifiable information.
- Critical or spiteful comments of other reviews or their authors posted on Chewy.com.
- Comments focusing on Chewy's customer service, pricing, shipping or delivery and not on the product being reviewed.
- Comments that encourage customers to purchase products from competitors or references competitors of the brand being reviewed or of Chewy.
- From anyone underage.
- If the product was not actually purchased by the reviewer, doesn't contain an actual experience with the product or purchased from a different retailer.
- Vacuous and unclear reviews and reviews related to a different product than the one being reviewed.
- False, inaccurate or misleading;
- Content that infringes any third party's copyright, patent, trademark, trade secret or other intellectual property rights or rights of publicity or privacy;
- Content that violates any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);
- Comments for which you were compensated or granted any consideration by any third party;
- Computer viruses, worms or other potentially damaging computer programs or files.
By submitting any content to Chewy, you represent and warrant that:
- you are the sole author and owner of the intellectual property rights thereto;
- all "moral rights" that you may have in such content have been voluntarily waived by you;
- all content that you post is accurate;
- you are at least 13 years old;
- use of the content you supply does not violate Chewy's, Privacy Policy, Terms of Use and these Terms and Conditions and will not cause injury to any person or entity.
You agree to indemnify and hold Chewy (and its officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers, including but not limited to Bazaarvoice, Inc.), harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown including reasonable attorneys' fees, arising out of a breach of your representations and warranties set forth above, or your violation of any law or the rights of a third party.
For any content that you submit, you grant Chewy perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.
All content that you submit may be used at Chewy's sole discretion. Chewy reserves the right to change, condense or delete any content on Chewy's website that Chewy deems, in its sole discretion, to violate the Guidelines or any other provision of these Terms and Conditions or the Terms of Use. Chewy does not guarantee that you will have any recourse through Chewy to edit or delete any content you have submitted. Ratings and written comments are generally posted within two to four business days. However, Chewy reserves the right to remove or to refuse to post any submission for any reason including for the reasons listed in the guidelines stated herein. You acknowledge that you, not Chewy, are responsible for the contents of your submission. None of the content that you submit shall be subject to any obligation of confidence on the part of Chewy, its agents, subsidiaries, affiliates, partners or third party service providers and their respective directors, officers and employees.
By submitting your email address in connection with your rating and review, you agree that Chewy and its third party service providers may use your email address to contact you about the status of your review and other administrative purposes.
