Chewy Text Message Program

Your Consent to Receive Automated Calls/Texts: Chewy may offer you the ability to receive marketing, transactional, and/or informational text messages at the mobile phone number you provide to us. Examples of texts you may receive include appointment confirmations and/or reminders; order confirmations; shipping and delivery notifications; prescription refill reminders and/or expirations; and new deals and/or sales. These messages can be recurring or one-time depending on the nature of the program, and frequency will be disclosed to you at the time of opt-in. By opting into any Chewy text program, you expressly consent to receive the applicable text messages (such as SMS, MMS, or successor protocols or technologies) and acknowledge that they may be sent using an automatic telephone dialing system, by or on behalf of Chewy, at the mobile phone number you provide us. Consent to receive texts is not a condition of purchasing any goods or services.  You verify that the mobile number provided to Chewy is true and accurate. You verify that you are the current subscriber or owner of any telephone number that you provide. As always, message and data rates may apply for any messages sent to you from us and to us from you. The maximum number of messages per month you will receive will vary based on the program you’ve enrolled in. If you have any questions about your text or data plan, it is best to contact your wireless provider. Please note we may not be able to deliver messages to all wireless providers, and Chewy and the carriers are not liable for delayed or undelivered messages. Opt Out Instructions: You can opt-out of the SMS service at any time. Just text "STOP" to any mobile message from Chewy to opt-out of that text messaging program. After you send "STOP" to us, you may receive a final communication confirming that your request has been received and processed. If you opt out of one Chewy text messaging program, you will remain opted out unless you opt in again separately.  We may use different shortcodes for different messaging purposes, so texting STOP to one shortcode will not effectuate a stop request for all shortcodes to which you are subscribed. If you would like to stop messages from multiple shortcodes, text STOP to each shortcode to which you would like to unsubscribe. 

Indemnification to Us: You agree to indemnify Chewy for any privacy, tort or other claims, including claims under the Federal Telephone Consumer Protection Act or any state law equivalents, including claims relating to your voluntary provision of a telephone number that is not owned by you and/or your failure to notify us of any changes in your mobile telephone number. You agree to indemnify, defend and hold us harmless from and against any and all such claims, losses, liability, costs and expenses (including reasonable attorneys’ fees).

Participation Requirements: By participating in any Chewy text messaging program, you acknowledge and agree that you are not under the age of thirteen (13) years, are between the ages of thirteen (13) and eighteen (18) and have your parent’s or legal guardian’s permission to participate in the program, or are of the age of majority in your jurisdiction.
