These “Official Rules” govern the 2025 Chewy Claus Sweepstakes (the “Sweepstakes”) sponsored by Sponsor (defined below). The Sweepstakes may only be entered in or from the 48 Contiguous United States and the District of Columbia and entries originating from any other jurisdiction are not eligible for entry. Open only to entrants who are 18 years of age or older and of the legal age of majority at the time of entry. This Sweepstakes is governed exclusively by the laws of the United States. You are not authorized to participate in the Sweepstakes if you are not located within the 48 Contiguous United States or the District of Columbia and at least 18 years of age.
1. How to Enter. To enter the Sweepstakes, during the Sweepstakes Period (as defined below), visit https://chewy.com/chewyclaus (the “Website”) and follow the on-screen entry instructions, which may include, without limitation, (a) submitting a “holiday wish list” letter on behalf of your pet, (b) indicating which Category (as defined below) of prize you are entering to win, and (c) furnishing your name, mailing address, email address, and such other information as Sponsor may require. At the time of entry, you may also elect whether to permit Sponsor to publish your pet’s letter on Sponsor’s Chewy Claus “Wishing Tree”. All information and materials submitted by entrant for the purposes of Sweepstakes entry will be referred to herein each as a "Submission." All Submissions must comply with the Guidelines and Restrictions defined below.
If you choose to enter using your mobile device, standard data fees may apply. You should consult your wireless service provider's pricing plan for details. You agree to incur any and all charges demanded by your wireless carrier.
By entering, each entrant warrants and represents the following with respect to entrant's Submission: (a) entrant is the sole and exclusive owner of the Submission; (b) the Submission is original and was created solely by the entrant; (c) the Submission will not infringe on any rights of any third parties; and (d) any third parties included in the Submission have given entrant appropriate consent to be included in the Submission in accordance with these Official Rules. Sponsor reserves the right to request releases from any third parties included in any Submissions at any time. Failure to produce third party releases upon Sponsor's request may result in disqualification, as determined by Sponsor is its sole and absolute discretion.
Limit one (1) entry per person. Entrants are not permitted to submit a Submission more than once during the Sweepstakes Period, and Entrants are not permitted to enter to win more than one (1) Category of prizes during the Sweepstakes Period. Duplicate or multiple Submissions by the same person will be subject to disqualification. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any email account, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorized account holder. Entry times will be determined using Sponsor’s computer.
All entries become the sole and exclusive property of the Sponsor and receipt of entries will not be acknowledged or returned. Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Proof of submission will not be deemed to be proof of receipt by Sponsor. By entering the Sweepstakes, entrants fully and unconditionally agree to be bound by these Official rules.
2. Sweepstakes Entry Start/End Dates. The entry period for the Sweepstakes begins on November 3, 2025 and continues through December 24, 2025 (the "Sweepstakes Period").
3. Eligibility. Participation open only to legal residents of the forty eight (48) contiguous United States and the District of Columbia, who are at least eighteen (18) years of age and the age of majority in their state of residence. Void outside of the 48 Contiguous United States, the District of Columbia, and where prohibited, taxed or restricted by law. Employees, officers and directors of Chewy, Inc. ("Sponsor") and its parent company, subsidiaries, affiliates, partners, advertising and promotion agencies, manufacturers or distributors of promotion materials, and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees, officers and directors are not eligible to enter. All federal, state and local laws and regulations apply.
4. Submission Guidelines and Content Restrictions: By entering the Sweepstakes, each entrant agrees that entrant's Submission conforms to the Submission Guidelines and Content Restrictions as defined below (collectively, the "Guidelines and Restrictions") and that Sponsor, in its sole discretion, may remove any Submission and disqualify an entrant or Submission from the Sweepstakes if it believes, in its sole discretion, that the entrant's Submission fails to conform to the Guidelines and Restrictions.
Submission Guidelines
- The Submission must be primarily in English.
Content Restrictions:
- The Submission must not contain material that violates or infringes any rights of any other party, including but not limited to copyright, trademark, privacy, publicity or any other intellectual property rights;
- The Submission must not disparage Sponsor or any other person or party;
- The Submission must not contain material that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous;
- The Submission must be truthful and accurate;
- The Submission must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age;
- The Submission must not contain material that is unlawful, in violation of or contrary to the laws or regulations of the United States or of any jurisdiction where Submission is created;
- The Submission must be consistent with the image and values of Sponsor and be consistent with and satisfy the purpose of the Sweepstakes.
Each entrant acknowledges that other entrants may have used ideas and/or concepts in their Submission that may be similar in idea or concept to what is included in entrant's Submission. Each entrant understands and agrees that they shall not have any claim against any other entrant or Sponsor arising out of any such similarity or be entitled to any compensation because of any such similarity.
Sponsor's decisions are final and binding in all matters relating to this Sweepstakes, including, but not limited to, interpretation and application of these Official Rules. By entering the Sweepstakes, entrants fully and unconditionally agree to be bound by these Official Rules.
5. Random Drawing/Odds. 15,000 prizes will be offered, allocated among 12 prize categories (each, a “Category”) as described in Section 6. On a rolling basis during the Sweepstakes Period on dates determined by Sponsor, potential winners in each Category will be selected in random drawings from all eligible entries for such Category received during the Sweepstakes Period up to such date. Odds of winning depend on the number of eligible entries received for the applicable Category at the time of the drawing. Drawing will be conducted by Sponsor or a Sponsor representative. By entering the Sweepstakes, entrants fully and unconditionally agree to be bound by these Official Rules.
6. Prize(s). Each prize consists of an assorted “goodie box” of items intended for the applicable Category: Cat Toy Box; Cat Treat Box; Cat Surprise Box; Multi-Pet Box; Dog Toy Box; Dog Treat Box; Dog Surprise Box; Bird Box; Small Pet Box; Reptile Box; Fish Box; and Horse Box. The approximate retail value (“ARV”) of each prize is USD $10. The estimated aggregate ARV of all prizes is $150,000.
All prize details that are not expressly specified in these Official Rules will be determined by Sponsor in its discretion. Restrictions may apply. The prize will be awarded if properly claimed. Prizes are non-transferable. No substitutions or cash redemptions. In the case of unavailability of any prize, Sponsor reserves the right to substitute a prize of equal or greater value. Each prize consists only of the items expressly specified in these Official Rules. All expenses or costs associated with the acceptance or use of the prize are the responsibility of winner(s). The prize is awarded “as is” and without any warranty, except as required by law. If the prize includes a gift card, gift card issuer’s terms and conditions apply. Limit one prize per person. All federal, state and local taxes on the value of the prize are the responsibility of the winner. An IRS form 1099 will be issued if required by law.
7. Notification. Potential winners will be notified between November 11, 2025 and January 15, 2026 and may be required to sign and return, where legal, an Affidavit or Declaration of Eligibility, Liability/Publicity Release and/or rights transfer document within five (5) calendar days of receipt. Additionally, potential winner(s) may be required to obtain releases from any and all third parties appearing in their respective Submissions.
Potential winners will be notified via mail at the mailing address provided by the winner when entering.
If any potential winner cannot be contacted within five (5) calendar days of first notification attempt, if any prize or prize notification is returned as undeliverable, if any potential winner rejects his/her prize or in the event of noncompliance with these Official Rules, such prize will be forfeited and will be awarded to an alternate winner selected at random from among the remaining eligible entries in the applicable Category as specified in these Official Rules (in which case the foregoing provisions regarding winner selection will apply to such newly-selected entrant). Upon prize forfeiture, no compensation will be given.
8. Grant of Rights. Participation in Sweepstakes and acceptance of prize constitutes each winner's permission for Sponsor to use his/her name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information, and/or any statements made by each winner regarding the Sweepstakes or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law. In addition, if an entrant indicates in connection with Sweepstakes entry that the entrant consents to the use of the entrant’s “holiday wish” letter, such consent will constitute a royalty-free, irrevocable, perpetual, non-exclusive license for Sponsor to use, reproduce, modify, publish, create derivative works from, display the entrant’s “wish list” letter on Sponsor’s 2025 Chewy “Wishing Tree”, and to incorporate it into other works, in any form, media or technology now known or later developed, for any purpose whatsoever, including for promotional or marketing purposes. in whole or in part, on a worldwide basis, in perpetuity.
9. Conditions. BY PARTICIPATING, ENTRANTS AND WINNERS AGREE TO RELEASE AND HOLD HARMLESS SPONSOR AND ITS ADVERTISING AND PROMOTIONS AGENCIES AND THEIR RESPECTIVE PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, PARTNERS, REPRESENTATIVES, AGENTS, SUCCESSORS, ASSIGNS, EMPLOYEES, OFFICERS AND DIRECTORS (COLLECTIVELY, "RELEASED ENTITIES"), FROM ANY AND ALL LIABILITY, FOR LOSS, HARM, DAMAGE, INJURY, COST OR EXPENSE WHATSOEVER INCLUDING WITHOUT LIMITATION, PROPERTY DAMAGE, PERSONAL INJURY AND/OR DEATH WHICH MAY OCCUR IN CONNECTION WITH, PREPARATION FOR, TRAVEL TO, OR PARTICIPATION IN SWEEPSTAKES, OR POSSESSION, ACCEPTANCE AND/OR USE OR MISUSE OF PRIZE OR PARTICIPATION IN ANY SWEEPSTAKES-RELATED ACTIVITY AND FOR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, INVASION OF PRIVACY, COPYRIGHT INFRINGEMENT, TRADEMARK INFRINGEMENT OR ANY OTHER INTELLECTUAL PROPERTY-RELATED CAUSE OF ACTION. Any and all federal, state and local taxes are the sole responsibility of the winners. Entrants who do not comply with these Official Rules, or attempt to interfere with this Sweepstakes in any way, shall be disqualified. Sponsor is not responsible if Sweepstakes cannot take place or if any prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism.
10. Additional Terms. Any attempted form of entry other than as set forth above is prohibited; no automatic, programmed, robotic or similar means of entry are permitted. Released Entities are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to enter the Sweepstakes, including any injury or damage to participant's or any other person's computer relating to or resulting from participating in this Sweepstakes or downloading any materials in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Sweepstakes should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, a notice will be posted on Sponsor’s Website and Sponsor will select the winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or Website. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
11. Limitation of Liability; Disclaimer of Warranties. IN NO EVENT WILL THE RELEASED ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ACCESS TO AND/OR USE OF ANY SITES ASSOCIATED WITH THE SWEEPSTAKES AND/OR THE SWEEPSTAKES ITSELF AND/OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY SITES ASSOCIATED WITH THE SWEEPSTAKES. WITHOUT LIMITING THE FOREGOING, THIS SWEEPSTAKES AND ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
12. Disputes; Governing Law. Dispute Resolution and Agreement to Individual Arbitration
EXCEPT FOR A CLAIM THAT MAY BE BROUGHT IN SMALL CLAIMS COURT, YOU AND CHEWY AGREE TO RESOLVE ANY COVERED DISPUTE WITH THE PROCESS DESCRIBED BELOW IN THIS DISPUTE RESOLUTION AND INDIVIDUAL ARBITRATION AGREEMENT (“DISPUTE RESOLUTION AGREEMENT”), WHICH INCLUDES AN AGREEMENT TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT, SUCH AS ACCESS TO DISCOVERY, ALSO MAY BE UNAVAILABLE OR LIMITED IN ARBITRATION.
Covered Disputes and Arbitration Requirement. Any and all disputes between you and Chewy, including disputes arising from or relating to the this Sweepstakes, these Official Rules, Site, the Chewy Terms of Use, the Privacy Policy, Autoship Terms and Conditions, Gift Card Terms and Conditions and any other terms and conditions that may apply to Chewy and its Sites or Services, programs and services and their interpretation or the breach, termination or validity thereof, any purchase on the Site, communications between you and Chewy, the reliance on any advice provided by independent contractors or third party veterinarians in connection with the Site, or any Products or promotions provided by Chewy, including disputes about the validity, scope or enforceability of this arbitration provision (collectively, "Covered Disputes") will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under the AAA's Consumer Arbitration Rules in effect on the date the claim was filed, available at www.adr.org . This arbitration agreement applies to any and all disputes occurring before or after this agreement and supersedes our previous arbitration agreements, subject to the right to opt-out described below. The arbitrator will have the power to grant whatever relief would be available in court under law or in equity, including public injunctive relief, and any award of the arbitrator(s) will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction. Notwithstanding the above, you or Chewy can bring any individual claim in small claims court consistent with the jurisdictional limitations of such court.
Governing Law. For purposes of this section, these Terms of Use and related transactions will be subject to and governed by the Federal Arbitration Act, 9 U.S.C. sec. 1-16 (“FAA”). To the extent state law applies to any portion of a proceeding brought by you or us, the applicable law will be the law of the state of your residence, as determined based on your shipping address on file with Chewy.
Fees and Costs. The AAA consumer rules will apply to determine the costs and expenses due from each party. In addition, if you are able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, you may be eligible for a waiver of fees under AAA’s rules.
Mass Arbitration. If 25 or more demands for arbitration are filed within one calendar year relating to the same or similar subject matter and sharing common issues of law or fact, the AAA’s Mass Arbitration Supplementary Rules and Consumer Mass Arbitration and Fee Schedule shall apply. However, if 1,000 or more mass arbitration demands are filed consistent with the requirements of this Dispute Resolution Agreement to individual arbitration, the relative advantages and efficiencies of arbitration may be lost. In that circumstance, you or we may elect to resolve the Covered Dispute by a putative class action filed in the state or federal courts encompassing Broward County, Florida. In that case, you and we agree not to object to the filing of a putative class action concerning the Covered Dispute, but do not waive any jurisdictional or other rights under the U.S. Constitution or Federal Rules of Civil Procedure, including the right to contest class certification under Rule 23.
Location. At your election, the arbitration will take place in the county in which you reside or, if you choose, by telephone, video conference, or based on the parties’ written submissions.
Required Pre-Arbitration Dispute Resolution. Prior to initiating any arbitration, the initiating party will give the other party at least 60-days' advanced written notice, along with any supporting documents and information, of its intent to file for arbitration (“Notice of Dispute”). Chewy will provide the Notice of Dispute by e-mail to your e-mail address on file with Chewy and you must provide the Notice of Dispute by e-mail to legal@chewy.com. The Notice of Dispute must be personally signed with wet ink or digital signature (e.g., Docusign) by you, if you are the initiating party, or a Chewy representative, if Chewy is the initiating party. During such 60-day notice period, the parties will endeavor to settle any Covered Disputes amicably by mutual discussions, and the applicable statute of limitations will be tolled for 60-days from the date the Notice of Dispute is received. Failing such amicable settlement and expiration of the notice period, either party may initiate arbitration. This provision is a precondition to any arbitration demand, and any party making an arbitration demand must certify that it has complied in good faith with this Pre-Arbitration Dispute Resolution requirement when filing an arbitration demand, and the AAA may not accept any demand without this certification.
CLASS ACTION WAIVER. CHEWY AND YOU AGREE THAT ANY COVERED DISPUTE SUBMITTED TO ARBITRATION OR SMALL CLAIMS COURT WILL BE ON AN INDIVIDUAL BASIS ONLY (EXCEPT AS SET FORTH IN THE “MASS ARBITRATION” PROVISION DESCRIBED ABOVE). NEITHER CHEWY NOR YOU ARE ENTITLED TO ARBITRATE ANY COVERED DISPUTE AS A CLASS, REPRESENTATIVE OR PRIVATE ATTORNEY ACTION (EXCEPT AS SET FORTH IN THE “MASS ARBITRATION” PROVISION DESCRIBED ABOVE) AND THE ARBITRATOR(S) WILL HAVE NO AUTHORITY TO PROCEED ON A CLASS, REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL BASIS (EXCEPT AS SET FORTH IN THE “MASS ARBITRATION” PROVISION DESCRIBED ABOVE). If any provision of the agreement to arbitrate in this section is found unenforceable, the unenforceable provision will be severed and the remaining arbitration terms will be enforced (but in no case will there be a class, representative or private attorney general arbitration).
Right to Opt Out of this Dispute Resolution Agreement. You may opt out of this Dispute Resolution Agreement by sending a notice (“Arbitration Opt Out Notice”) within the first 30 days after the earliest of the first time you (a) make a purchase from the Chewy; or (b) create an account or otherwise sign up for any program or service provided by Chewy. You may also opt out of this Dispute Resolution Agreement by sending an Arbitration Opt Out Notice within 30 days after we notify you regarding a material change to this Dispute Resolution Agreement. To opt out of this Dispute Resolution Agreement, you must send a signed Arbitration Opt Out Notice via email legal@chewy.com or via mail to ATTN: Chewy Legal Department, 7700 West Sunrise Boulevard, Plantation, Florida 33322. Your Arbitration Opt Out Notice should be personally signed and dated and should include the following information: (1) your full name (2) your mailing address (3) your email address associated with your Chewy Account or Chewy order and (4) a clear statement that you wish to opt of this Dispute Resolution Agreement.
Miscellaneous. Notwithstanding any provision in these Terms to the contrary, we agree that if Chewy makes any future material change to this Dispute Resolution Agreement, it will not apply to any individual claim(s) for which you had already provided notice to Chewy. In the event that this Dispute Resolution Agreement does not apply to a given dispute, then the parties agree to the exclusive jurisdiction of the state and federal courts in Broward County, Florida to resolve such claims.
13. Use of Data. Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy. Please review Sponsor's privacy policy https://www.chewy.com/app/content/privacy. By participating in the Sweepstakes, entrants hereby agree to Sponsor's collection and usage of their personal information and acknowledge that they have read and accepted Sponsor's privacy policy.
14. Meal Donations. For each entry received, Chewy will donate 5 Meals to pets in need. A “Meal” is defined as 1 cup of food for an average dog and ¼ cup of food for an average cat. Chewy will donate a maximum of 16 Million Meals.
15. Name of Winner/List of Winners. To obtain the name(s) of winner(s), send a self-addressed, stamped envelope no later than four (4) weeks after the conclusion of the Sweepstakes Period to: Chewy, Inc. 7700 West Sunrise Boulevard, Plantation, Florida 33322 Att: Marketing Department.
