Welcome to the terms and conditions ("Terms") for the Chewy+ membership program. These Terms are between you and Chewy, Inc. and/or its affiliates ("Chewy" or "Us") and govern our respective rights and obligations. Please note that your use of the Chewy.com website and Chewy+ are also governed by the agreements listed and linked to below, as well as all other applicable terms, conditions, limitations, and requirements on the Chewy.com website, all of which (as changed over time) are incorporated into these Terms. If you sign up for a Chewy+ membership, you accept these terms, conditions, limitations and requirements.

BY ACCEPTING THESE TERMS, YOU REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, AUTHORITY, AND CAPACITY TO ENTER INTO THE TERMS AND TO ABIDE BY ALL OF THE REQUIREMENTS SET FORTH HEREIN. YOU MAY NOT ACCESS OR USE THIS SITE OR ACCEPT THESE TERMS OF USE UNLESS YOU ARE AT LEAST 18 YEARS OLD.

ARBITRATION NOTICE: YOUR CHEWY+ MEMBERSHIP IS SUBJECT TO THE ARBITRATION CLAUSE INCLUDED IN THE CHEWY TERMS OF USE. YOU AND CHEWY AGREE THAT DISPUTES BETWEEN US WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION, AND YOU AND CHEWY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Membership Fee, Renewal & Cancellation

The membership fee for Chewy+ is stated on the Chewy+ membership page. From time to time, we may offer different membership terms, and the fees for such membership may vary. We have the right to change member fees, membership benefits and membership terms at any time without notice. If you participate in a separate membership or similar program by Chewy, different terms and conditions apply. Unless stated expressly, discounts and benefits of participating in multiple programs offered by Chewy are not compounded and may not be used together.

The Chewy+ membership fee is non-refundable except as expressly set forth in these Terms. Taxes may apply on either or both of the membership fee and the reduced shipping and handling charges for Chewy+.

If all eligible payment methods we have on file for you are declined for payment of your membership fee, you must provide us with a new eligible payment method promptly or your membership may be canceled without notice. If you provide us with a new eligible payment method and are successfully charged, your new membership period will be based on the date of the successful charge.

UNLESS YOU NOTIFY US BEFORE A CHARGE THAT YOU DO NOT WANT TO AUTO RENEW, YOU UNDERSTAND YOUR CHEWY+ MEMBERSHIP WILL AUTOMATICALLY CONTINUE AND YOU AUTHORIZE US (WITHOUT NOTICE TO YOU, UNLESS REQUIRED BY APPLICABLE LAW) TO COLLECT THE THEN-APPLICABLE MEMBERSHIP FEE AND ANY TAXES, USING ANY ELIGIBLE PAYMENT METHOD WE HAVE ON RECORD FOR YOU.

 

You may end your Chewy+ membership by visiting your account or calling Customer Service at 1-800-672-4399, subject to certain restrictions and charges. If you end your Chewy+ membership, you can continue to use your Chewy+ membership until the end of your paid membership term. If you end within 3 business days of signing up for or converting from a free trial to a paid membership, we will refund your full membership fee on the original method of the payment; provided that we may withhold from your refund the value of Chewy+ membership benefits used by your account during this 3-business day period if less than the membership fee. If you end at any other time, we will refund your full membership fee only if you and your account did not make any eligible purchases or take advantage of Chewy+ benefits since your latest Chewy+ membership charge.

 

Shipping Benefits and Eligible Purchases

Chewy+ benefits depend upon inventory availability and additional restrictions as Chewy may communicate from time to time. They are limited to certain eligible products sold by Chewy.com on the Chewy.com website. Products eligible for free shipping will be indicated as eligible on product detail pages. Some special product, order, handling fees, and/or taxes may still apply to eligible purchases. We may exclude products with special shipping characteristics at our discretion. Chewy+ Rewards

For every eligible $1 USD purchase on Chewy.com website, after discounts and promotions applied and before taxes, you will earn $0.05 credit “Chewy+ rewards” that can be redeemed for your future eligible purchases on Chewy.com if you have more than $0.01 in Chewy+ rewards. The amount of credit earned on each transaction is an estimated amount until the order is shipped, at which point the rewards earned will be reflected in your available rewards balance. Please note that Chewy+ rewards has no cash or other monetary value other than redeemable value determined by Chewy on Chewy.com website. Chewy+ rewards are not transferrable and shall expire and any Chewy+ rewards will be forfeited without compensation if not used by the last day of the month 12 months from earning Chewy+ rewards. Purchases of Gift Cards and insurance products, such as CarePlus plans, are not eligible to earn Chewy+ Rewards. Chewy at it’s sole discretion may decide to change the earn rate and/or eligibility criteria of the Chewy+ Rewards or terminate your Chewy+ Rewards at any time without notice. Chewy at it’s sole discretion may decide for which products and services Chewy+ Rewards can be earned or redeemed. Chewy Plus Rewards can be earned on purchases limited to $3,000 in a given year. Any purchases of eligible products cannot be used to earn Chewy+ Rewards, if the customer’s annual spend on Chewy is over $3,000.

 

Exclusive Member Offers and Promotions

From time to time, we will offer Chewy+ members additional, limited time offers, including discounts on products, rewards multipliers on certain categories, and exclusive promotional periods. Chewy+ members are eligible for such offers only during the time period communicated. Chewy reserves the right to limit offer eligibility based on Chewy history, purchase history, and other similar defining behavior characteristics. Chewy may choose in its sole discretion to remove offers at any time. Each offer will be subject to its own terms and conditions.

We reserve the right to change these benefits at any time without notice. Any benefits are subject to applicable laws and regulations and some benefits may not be available where you reside.

 

Other Limitations

·        We reserve the right to accept or refuse or terminate membership at our discretion.

·        We may send you email and other communications related to Chewy+.

·        You may not transfer or assign your Chewy+ membership or any Chewy+ benefits, including promotion codes for Chewy+ memberships or benefits, except as allowed in these terms.

·        Chewy+ members are not permitted to purchase products for the purpose of resale, rental, or to ship to their customers or potential customers using Chewy+ benefits.

·        Some Chewy+ benefits may require certain purchase thresholds, have quantity or shipping address limitations, or require members to meet specified criteria in order to access them.

·        Chewy+ is limited to individuals and households purchasing for their own personal or household use; use for resale or bulk purchases is prohibited.

·        From time to time, Chewy may choose in its sole discretion to add or remove Chewy+ membership benefits without notice.

We will collect and use your Personal Information as described in our Privacy Policy.

 

Agreement Changes

We may in our discretion change these Terms, Chewy’s Terms of Use and Privacy Policy, or any aspect of Chewy+ membership, without notice to you at any time. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. EXCEPT WHERE REQUIRED BY LAW, YOUR CONTINUED MEMBERSHIP AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST END YOUR MEMBERSHIP.

 

Termination by Us

We may terminate your Chewy+ membership at our discretion without notice. If we do so, we will give you a prorated refund based on the number of full months remaining in your membership. However, we will not give any refund for termination related to conduct that we determine, in our discretion, violates these Terms or any applicable law, involves fraud or misuse of the Chewy+ membership, or is harmful to our interests or another user. Our failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights.

 

Limitation of Liability

IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN CHEWY’S TERMS OF USE, OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE LAST MEMBERSHIP FEE YOU PAID. THIS LIMITATION OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR CHEWY+ MEMBERSHIP.

 

Dispute Resolution and Agreement to Individual Arbitration

Any and all disputes between you, and Chewy, including disputes related to Chewy+, your Chewy+ membership, and/or these Chewy+ Terms and Conditions, will be resolved under our dispute resolution and arbitration agreement, found in the Chewy Terms of Use.
